Terms of Service

These terms are a plain-English agreement between you and Commense. Please read them — especially the disclaimers in §8 and §9, which limit what you can rely on the app for and our liability to you.

1. Who we are, and agreeing to these terms

Commense (“Commense”, “we”, “us”, “our”) is a personal dashboard for tracking habits, mood, cycle, money, and goals. It is operated by Commense App (ABN 85 703 121 204), based in Australia.

By creating an account or using Commense, you agree to these Terms of Service and to our Privacy Policy. If you don’t agree, please don’t use the app.

2. Who can use it

You must be at least 16 years old to use Commense. By using it, you confirm you are. If you use Commense on behalf of an organisation, you confirm you’re authorised to accept these terms for it.

3. The service, and that it’s early

Commense is provided on an ongoing, evolving basis. During beta and early release, features may change, break, or be removed, and the app may be unavailable at times. We may add, change, or discontinue features at any time.

Your data during beta. We take reasonable care of your data (see §7 of the Privacy Policy), but beta software carries a higher risk of bugs and, in rare cases, data loss. Please don’t rely on Commense as the only place your important information lives.

7. AI features

Commense offers optional AI categorisation of transactions (off by default). If you enable it, transaction descriptions are sent to our AI provider to suggest a category, as described in the Privacy Policy (§4). AI suggestions can be wrong — review them. Your mood, cycle, and health-related data are never sent to the AI.

8. Important: what Commense is not

Commense is not financial advice. It helps you record and visualise your own money data. It does not provide financial, investment, tax, or accounting advice, and nothing in it is a recommendation to take any financial action. Figures, categories, projections, and “pace” indicators are informational only and may be incomplete or inaccurate (for example, they reflect only the data you import). Make financial decisions with a qualified professional, not based on Commense.
Commense is not medical advice. The mood and cycle features are for your own personal tracking and reflection. They are not a medical device, not a diagnostic tool, and not a contraceptive or fertility method. Cycle predictions are estimates based only on the dates you enter and can be inaccurate. Do not rely on them to prevent or achieve pregnancy, or to make any health decision. For anything health-related, speak to a qualified healthcare professional.

9. Warranties and disclaimers

To the maximum extent permitted by law, Commense is provided “as is” and “as available”, without warranties of any kind — we don’t guarantee it will be uninterrupted, error-free, secure, or that it will meet your needs or that data will never be lost.

Australian Consumer Law. Nothing in these terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law or other laws that cannot lawfully be excluded. Where our liability for breach of such a guarantee can be limited, it is limited (at our option) to re-supplying the service or paying the cost of having it re-supplied.

Commense is currently free to use. If we introduce paid plans, we’ll present the price and terms before you subscribe, and payments will be handled by our payment provider (see the Privacy Policy, §5). Any plan-specific terms will apply in addition to these.

We may update these terms. If a change materially affects you, we’ll let you know (for example by email or in the app) before it takes effect. Continuing to use Commense after a change means you accept the updated terms.

14. Governing law

These terms are governed by the laws of Australia, and you and we submit to the non-exclusive jurisdiction of the Australian courts. (This does not remove any protection available to you under the law of the country where you live.)
